Printing SA has shared that the National Treasury has published the 2026 draft General Public Procurement Regulations, and the draft Public Procurement Tribunal Regulations, for public comment in terms of section 63 (1) of the Public Procurement Act, 2024 (Act No. 28 of 2024). These drafts were released through Government Gazette Nos. 54528 and 54527 respectively.
This marks a significant step in the implementation of the new public procurement framework, which aims to consolidate and modernise procurement laws across all spheres of government.
Key Highlights And Proposed Changes
Take note of the following key aspects introduced or clarified in the draft regulations:
Centralised procurement framework: The regulations give further effect to a more standardised and centralised procurement system, with enhanced oversight by the Public Procurement Office.
Preferential procurement measures: The draft regulations provide more detailed guidance on the application of preferential procurement, including mechanisms to advance historically disadvantaged individuals and promote local content.
Local production and content requirements: Greater emphasis is placed on localisation, which may have direct implications for the printing and packaging sector, particularly in relation to designated products and minimum local content thresholds.
Procurement integrity and transparency: Strengthened provisions relating to ethical conduct, conflict of interest, bid evaluation processes, and disclosure requirements are included to improve transparency and accountability.
Dispute resolution, public procurement tribunal: The draft Tribunal Regulations outline procedures for lodging complaints, appeals, and reviews of procurement decisions, introducing a more structured and accessible dispute resolution mechanism.
Compliance and enforcement: The regulations set out clearer compliance obligations and potential consequences for non-compliance by both procuring institutions and suppliers.

Printing SA will be preparing a consolidated industry submission in response to these draft regulations. Members are strongly encouraged to review the proposed regulations and provide input, particularly on issues that may impact:
– Access to public sector printing and packaging tenders.
– Local content requirements and supply chain implications.
– Administrative and compliance burdens.
– Dispute resolution processes.
The due date for submitting comments on the 2026 draft Public Procurement Tribunal Regulations is 15 May 2026. Due to the length and complexity of the 2026 draft General Public Procurement Regulations a longer consultation period has been determined by the Minister of Finance and the due date for submitting comments thereon is 15 June 2026.
